These Terms of Service ("Terms") apply to your access to and use of the websites, digital products, and services (collectively, "Services" or "Telehealth Services") provided by Thailand Telehealth ("Thailand Telehealth" "we" or "us").

The Services are not intended for use in an emergency.

If you are experiencing a medical emergency, call 1669.

It is your responsibility to seek appropriate emergency care immediately if your condition worsens while waiting for consultation or treatment.

You may use the Services only if you agree to form a binding contract with us.

If you accept these Terms on behalf of another legal entity, you represent that you have full legal authority to bind such entity to these terms.

You may use the Services only in compliance with these Terms and all applicable laws, rules, and regulations.

You must be at least 20 years old to register and use the Services, or you must be the parent or legal guardian of someone under age 20 who is enrolled in the Services.

In using the Services, you agree not to:

• Misrepresent your identity in any way;

• Gain unauthorized access to the Services;

• Allow any other person to use the Services with your registration.

You understand that through your use of the Services you consent to our Privacy Policy.

Please read these Terms carefully and make an informed decision before using any of the Services.

Telehealth Services are not intended to be used for all medical conditions.

Benefits of telehealth include but are not limited to, convenience, efficiency, improved healthcare access, and prevention of hospital-acquired infections.

Limitations of telehealth include but are not limited to, limitations with performing comprehensive physical examinations, technical difficulties, and data security breaches.

The Consulting Doctor ("Consulting Doctor") reserves the right to make a professional judgment about the suitability of your condition for the Telehealth Consultation ("Telehealth Consultation" or "Consultation") and the Telehealth Services.

The waiting time for your Consultation is not guaranteed and may be delayed due to Consulting Doctor availability or unforeseen circumstances.

Our Telehealth Consultations are not for medical certificate requests.

You agree not to record your Consultation in any form, including, but not limited to, recording audio or video, except with our prior written consent.

By clicking the "Request Now" button to initiate a consultation request or the "Confirm" button to confirm an in-person nurse or doctor visit, you acknowledge and agree that your request is final and may not be canceled or refunded, except where required by applicable law or explicitly permitted in these Terms.

This policy is necessary due to the immediate allocation of medical professionals and scheduling resources upon confirmation.

All times displayed on our website or Services — including, but not limited to, estimated start times for doctor consultations, delivery of treatments, and in-person visits — are approximate and not guaranteed. Actual times may vary due to availability, medical urgency, location, or unforeseen circumstances.

You are solely responsible for monitoring your own health condition. If your condition worsens while waiting for consultation or treatment, it is your responsibility to seek emergency care immediately.

If certain medications, diagnostic investigations, in-person visits, or treatments are not available through the Platform at the time of consultation, your Consulting Doctor may provide a medical referral or alternative care recommendation.

You acknowledge and agree that the doctor consultation fee and any applicable platform usage fees remain non-refundable under all circumstances, including if you decline or reject the referral or are unable to act upon it for any reason.

This policy ensures fair compensation for professional time and platform resources utilized during your consultation.

For all in-person visits by nurses or doctors, you are required to proactively disclose any potential safety concerns or risks related to access to the location, including but not limited to environmental hazards, security threats, or unsafe travel conditions.

You are solely responsible for ensuring a safe environment for medical professionals, including but not limited to:

• Securing access to the premises;

• Restraining pets or animals;

• Maintaining overall safety of the surroundings.

Attending medical personnel reserve the full right, at their sole professional discretion, to decline or cancel a scheduled in-person visit at any time if the destination or journey thereto is deemed unsafe or poses a potential risk of harm.

This decision is made at the sole discretion of the attending medical personnel and does not require prior approval or appeal.

If you fail to disclose relevant safety risks in advance or do not provide a reasonably safe environment during the visit, and such negligence leads to the cancellation of the visit or harm to the attending medical personnel, you will remain fully liable for all confirmed medical fees and any damages, losses, or additional costs incurred by Thailand Telehealth and its staff as a result of your omission or negligence.

Any medical documents delivered to you via email or through the Platform — including but not limited to medical reports, treatment plans, prescriptions, receipts, or billing summaries — should be carefully reviewed upon receipt.

You are responsible for notifying us of any errors, omissions, or necessary corrections within seven calendar days of the date the document was sent.

After this period, no further modifications or corrections will be made, and the document will be deemed final and accurate.

Thailand Telehealth is not responsible for any consequences resulting from the user's failure to review or request corrections within the specified timeframe.

We may offer payment through a third-party payment provider.

You acknowledge and agree that we have no control over the actions of the third-party payment provider, and all payment information is collected and stored through the third-party payment provider.

We reserve the right to cancel your Consultation for any reason, including, but not limited to, unavailability of the Consulting Doctor. If we cancel your Consultation due to a lack of available Consulting Doctors, we will provide you with a full refund of the Consultation fee.

We reserve the right to cancel your Consultation in progress if your behavior towards the Consulting Doctor becomes abusive or inappropriate, or if we encounter technical issues. If the cancellation is caused by your inappropriate behavior, you will not be entitled to a refund. If the cancellation arises from our technical difficulties, we will issue a full refund of the Consultation fee.

You must provide accurate and complete registration information.

It is your responsibility to provide us with a true, accurate, and complete e-mail address, physical address, and other information, and to maintain and update promptly any changes in this information.

You acknowledge and consent to receive communications by email, text message, telephone calls, and other reasonable means.

You agree that in providing the Services, we may use and disclose your information for treatment, payment, and healthcare operational purposes.

If you provide suggestions, ideas, or feedback ("Feedback") to us, we are free to use, disclose, reproduce, license, or distribute the Feedback, without an obligation or restriction to you.

You are responsible for maintaining the confidentiality of your private URLs generated for you when you use the Services, and you are fully responsible for all activities that occur through your private URLs.

You are responsible for obtaining, installing, maintaining, and operating all software, hardware, and other equipment (collectively, "Equipment") necessary for you to access and use the Services.

You are responsible for obtaining internet services.

You acknowledge that there are certain security, transmission error, and access availability risks associated with using the internet, and you hereby expressly assume such risks.

You are responsible for the data security of the Equipment used to access the Services.

We are not responsible for any errors or problems that arise from the malfunction or failure of the internet or your Equipment.

We reserve the right to suspend or terminate your use of the Services for any reason, including, but not limited to, a belief that your conduct or your use of the Services violates applicable laws or is harmful to the interests of Thailand Telehealth or any other users.

We also may place limits on, modify, suspend, or terminate the Services generally.

All content, features, functionality, and materials provided through the Services — including, but not limited to, the platform's design, layout, user interface, user experience elements, text, graphics, logos, icons, images, software code, and multimedia content — are the exclusive intellectual property of Thailand Telehealth or its licensors, and are protected by applicable copyright, trademark, trade dress, and other intellectual property laws in Thailand and other jurisdictions.

You agree not to:

• Copy, reproduce, distribute, modify, adapt, or create derivative works from any part of the Services;

• Reverse engineer, decompile, disassemble, or otherwise attempt to extract the source code or internal logic of any software used on the platform;

• Use, display, mirror, or frame any part of the Services, platform design, or its components without our prior written authorization.

The visual identity, user interaction logic, functional workflows, and interface architecture of the Thailand Telehealth platform are the result of proprietary design and development efforts by Thailand Telehealth. These constitute trade dress and intellectual property assets protected under Thai and international law. Any unauthorized use, imitation, or reproduction of these unique platform elements is prohibited.

Thailand Telehealth reserves all rights not expressly granted under these Terms.

These Terms are personal to you and are not assignable, transferable, or sublicensable by you except with our prior written consent.

Thailand Telehealth may assign, transfer, or delegate any of its rights and obligations hereunder without your consent.

These Terms shall be governed by and construed in accordance with the laws of Thailand, without regard to its conflict of law principles.

If any provision of these Terms is held to be void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.

We may revise these Terms from time to time.

Any changes to the Terms will be effective immediately upon posting of the revised Terms.

It is your responsibility to continuously monitor these Terms for any changes or updates.

By continuing to access or use the Services on or after the Effective Date of the revised Terms, you agree to be bound by the revised Terms.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. YOUR USE OF THE SERVICES ARE AT YOUR OWN RISK. ACCESS TO THE SERVICES MAY BE INTERRUPTED AND INFORMATION, SERVICES, AND MATERIALS MAY NOT BE ERROR-FREE.

NONE OF THAILAND TELEHEALTH, ITS AFFILIATES, OR ANYONE ELSE INVOLVED IN CREATING, PRODUCING, OR DELIVERING THE SERVICES AND MATERIALS CONTAINED THEREIN ASSUMES ANY LIABILITY OR RESPONSIBILITY FOR THE ACCURACY, COMPLETENESS, OR USEFULNESS OF ANY INFORMATION, SERVICES, AND MATERIALS PROVIDED ON THE SERVICES; THEY ALSO SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF, OR YOUR INABILITY TO USE THE SERVICES FOR ANY REASON. YOU ACKNOWLEDGE AND AGREE THAT THE LIMITATIONS SET FORTH ABOVE ARE FUNDAMENTAL ELEMENTS OF THESE TERMS AND THE SERVICES WOULD NOT BE PROVIDED TO YOU ABSENT SUCH LIMITATIONS.
